If this provision is discovered to be unlawful or unenforceable, then neither Bash will elect to arbitrate any Dispute falling within just that portion of this provision found for being illegal or unenforceable and such Dispute shall be resolved by a court docket of capable jurisdiction within the courts detailed for jurisdiction earlier mentioned,
